What does the New York State Sexual Harassment Prevention law say?
NEW YORK STATE:
All New York employees must complete sexual harassment prevention training that meets or exceeds the minimum standards under the law by no later than October 9, 2019, after which future training must be completed on an annual basis. Posting, policy and notice requirements went into effect October 9, 2018. New employees must be trained as soon as possible after their start date.
NEW YORK CITY:
New York City employers with at least 15 employees are required to conduct annual anti-sexual harassment training for all employees starting April 1, 2019. Posting, policy and notice requirements went into effect September 6, 2018.
Employers must keep a record of all trainings, including signed employee acknowledgments (which may be electronic) for at least three years.
Those subject to the training requirements must be trained every calendar year, as opposed to within one year of their last training.
WHO NEEDS TO BE TRAINED?
- All employees regardless of immigration status, full-time and part-time employees, seasonal employees and temporary employees must receive training.
- Employees who work a portion of their time in New York State, even if they’re based in another state.
- NYC: All employees, including short-term or part-time employees, as well as independent contractors, are subject to the training requirements if they: Work more than 80 hours in a calendar year and work for at least 90 days
